Am I eligible for the stimulus check? My mom claimed me as a dependent but I don’t live with her and I’m 20 years old. I also attended college for 5 months last year and filed my taxes.

Am I eligible for the stimulus check? My mom claimed me as a dependent but I don’t live with her and I’m 20 years old. I also attended college for 5 months last year and filed my taxes.

Anyone is claimed as a dependent on someone else's tax return is not eligible to receive the stimulus payment. Whether or not your mom should have claimed you as a dependent depends on whether you met the following requirements or not. Here are the requirements from your mother's viewpoint:

 

1. The child must be your son, daughter, stepchild, foster child, brother, sister, half brother, half sister, stepbrother, stepsister, or a descendant of any of them.
2. The child must be (a) under age 19 at the end of the year, (b) under age 24 at the end of the year and a full-time student, or (c) any age and permanently and totally disabled. A full time student is a student who was full time for at least 1 day of five different months during the year. 
3. The child must have lived with you for more than half of the year. Temporary absences while away at college are considered living with you.
4. The child must not have provided more than half of his or her own support for the year.
5. If the child meets the rules to be a qualifying child of more than one person, you must be the person entitled to claim the child as a qualifying child.
6. The child must be a U.S. citizen or U.S., Canada or Mexico resident for some portion of the year.
7. The child must be younger than you (or your spouse, if filing jointly) unless disabled.

 

If she should not have claimed you but did, you will have to print and mail your return to get it accepted to claim yourself. You should try to get your mother to prepare, print and mail an amended return form 1040X to take you off her return as a dependent. If both you and your mom try to claim you, the IRS will come back to both of you later in the year to sort out who should have claimed you.

@Texas Roger Thank you for your response. One more questions. Turbo Tax asked was someone able to claim me as a dependent, I said yes. I went to the IRS website and spoke to a tax account and both said it was okay for my mother to claim me. Also I wasn’t living with her last year, I moved. So would I still have to reprint and correct things with the IRS still?
