1099-MISC and CA 592-B missing Payee SSN

Hello,

I received a settlement check, and the tax forms (1099-MISC and CA 592-B) provided do not have my SSN. (Long story short, they have my maiden name but correct address, they couldn't find me with the SSA, sent me a W-9 asking for my SSN, but I thought it was a scam so I ignored.)  Now that I have the check, I tried calling the payer for corrected forms, and they told me they could not give me them because the check had been issued. This seems weird to me because the IRS website says to contact the payer for a corrected form, but the payer was firm that I could not get corrected forms and had to contact my "tax specialist." (I would think they would've wanted my SSN for tax purposes on their end, but okay.)

1) That said, I just want to know - will there be any issues on my end if the forms 1099-MISC and 592-B do not have my SSN on them, and I file? Any additional action needed on my part at this point?

2) I use Turbo Tax and will obviously be claiming this on my Federal Taxes, as well as state. I live in IL. Since the state of the payer is CA, knowing what I know about taxes, I'll have to file an additional state for CA state taxes since there is no reciprocity with IL, right?

1099-MISC and CA 592-B missing Payee SSN

If Forms 1099-MISC and 592-B do not have your Social Security Number (SSN) on them, there can be potential implications for both you and the entity that issued the forms. Here’s what to consider:

1. IRS Reporting Issues:

  • Incomplete Information: The IRS uses your SSN to track income and ensure proper reporting. If the form is missing your SSN, it may not accurately reflect your income, which could lead to discrepancies in your tax return.
  • Potential for IRS Notices: If the IRS receives a 1099 form without your SSN, they may send you a notice requesting clarification or additional information.

2. Filing Your Taxes:

  • Tax Return Processing: If you're unable to provide accurate documentation on your tax return due to missing SSNs, it could delay the processing of your return and potentially delay your refund.
  • Using a Substitute: If you don’t have the forms with the correct SSN, you should try to obtain corrected forms from the issuer. If not possible, you may need to report the income accurately on your tax return based on your own records (e.g., invoices, bank statements).

3. Backup Withholding:

  • If your SSN is missing from the forms, the payer may be required to withhold federal taxes from your payments at a higher rate (backup withholding). This means that you may receive less money than expected.

4. Correcting the Issue:

  • Contact the Issuer: Reach out to the issuer of the forms to request corrected versions that include your SSN. It is their responsibility to ensure that the information reported to the IRS is accurate.
  • Document Your Attempts: Keep records of your communication with the issuer regarding this issue in case you need to prove that you made an effort to correct it.

5. IRS Form 8949:

  • If you have incomplete or incorrect information on your 1099 forms, you may consider filing Form 8949 to report capital gains or losses accurately.

Conclusion:

While not having your SSN on these forms can lead to complications, taking proactive steps to correct the issue can help mitigate potential problems. If you are concerned about how this might affect your tax situation, consider consulting a tax professional for personalized advice.
