Will my child's father tax return come to me?

I'm wondering if my childs father return will come to me like it did last year. He claimed my daughter on his tax return last year and this year without my permission before I could file her. (I reported him last yr to irs) Last year he owed about 6000 in arrear this year he owes about 3000 his return is suppose to be 4000 I believe just estimating. Last year his entire return came to my account unexpectedly curious what will happen this year since he pulled the same sneaky routine. (TEXAS) and never married my daughter lives with me all year except for when she visits him.

I have never heard of that.  Does he owe back child support to you?  Could that be what happened they took his refund (it called an offset) for his back child support and it eventually got deposited into your account?  This would not have been the IRS that made the deposit,  this would have been the child support agency who got the refund (filed an offset) and then deposited into your account.

You need to go ahead and file a return claiming your daughter and mail in to the IRS, disputing his claiming your daughter complete with documentation.   If he owes you child support, you still need to claim your daughter to get all the refund you can get.  The IRS will go after him to pay them back the erroneous refund he received.

What I am trying to say is if he claimed your daughter, used her exemption in order to get a large refund to pay the back child support, that still is not right.  He owes that anyway without claiming your daughter.

If you did not claim your daughter last year (file a paper return) and you are legally entitled to do so, you need to amend your return for 2016 also.  Claiming your daughter could result in you getting a nice refund.

I may be totally misunderstanding-so if I am I apologize in advance!

Yes he owes arrears about 3000 I've already e-filed with turbo tax and they took my child credit because he had already claimed her. This allows him to get more money back 4500 or more. Last year the full return came to me because he owed like 6000 but this year its a little different because the arrears are lesser then the return so I'm wondering will I get the 3000 grand at least and the rest goes to him or will the full return come to me again since he got the credit and not me.  I am going to call the office Monday to ask just wanted some opinions on how it will work this year.

No the IRS will not send his refund to you. The IRS will only deal with him on his return.  Texas child support agency might have an offset in place to keep the refund and then send your child support to you. The IRS never sends someones refund to another person/bank account. How would the IRS know your bank information? As I said earlier, I suspect he got his refund BUT then It was held by the Texas child support agency (it was an offset) to pay your  back child support. It is two different things.

So what I am trying to say to you is you need to AMEND 2017 and claim your daughter CORRECTLY and get your own personal refund back.  He is claiming your daughter in order to get enough money to pay your child support and that is not right. He is not entitled to claim your daughter. He should pay child support anyway not "steal" your exemption. You need to look at your bank information from last year and see where that deposit came from I do not think it was the IRS. Again the IRS would only send his refund to him, BUT his refund was offset because of his child support debt.
