They are required to file a tax return to claim all self employment income more than $400 to pay self employment taxes. You are allowed by tax law to claim the child care credit if you qualify for it.

They have no choice. What you paid them is self-employment income and they must report all of it. They will owe self-employment taxes even if they owe no ordinary income tax.
