Dependent care benefits

A married couple has earned income from only the spouse. The spouse participates in a dependent care benefit plan under his employer's cafeteria plan. These benefits are in box 10 of W-2 and not included in box 1. Do they have to add back the $5,000 benefit to their 1040?

You (and your spouse if filing jointly) must have earned income to take the credit or exclude dependent care benefits from your income.
