Issues with the Affordable Care Act (Form 1095-A) section for self-employed

Hello. I am having issues with the Affordable Care Act (Form 1095-A) section in Deductions & Credits. I am not sure if I should check the "I'm self-employed and bought a Marketplace plan" in my case.

 

I had 3 separate jobs in 2020

1) I had an S Corp which closed with the end of 2020, I received a K-1 from the S corp but no W-2
2) I worked on a W-2 until 10/2020
3) I am self employed from 09/2020 and receiving a 1099

 

So in 2020 I was an S Corp shareholder, a W-2 employee and a 1099 contractor

 

Now, I have three options to do in the 1095-A section:

1) Not selecting the "I'm self-employed and bought a Marketplace plan" box

2) Selecting the "I'm self-employed and bought a Marketplace plan" box and checking my S Corp on the next page - which gives me the highest refund

3) Selecting the "I'm self-employed and bought a Marketplace plan" box and checking my 1099 self-employment on the next page - which gives me the lowest refund and and an error on the Review page (due to a negative amount in 1040/1040SR Worksheet, Schedule 1, Part 2, Item 16)

 

I would really appreciate your help as each tax specialist from live chat is giving me different information and I am very confused.

Are you SURE that #2 gives you a higher refund and that #3 gives you a lower refund?  It SHOULD be the other way around.  Or do you OWE money and #2 shows you OWE more than #3?

 

As for the error, the developers messed up the programming in this regard, so I'm not sure what to advise you in that regard.

I was self employed on 1099 when since 08/2020 so I selected September to December. This caused the error and my refund to be the lowest. A tax specialist advised that I check box #3 and mark it as January to December. 

 

Do you think that this would be correct?

No, you can't mark it as January  through December if that business did not exist during all of that time.

 

If you were not ELGIBLE for health insurance through your W-2 employer, you can count August (but you can't count Sept or Oct if you were eligible for insurance for those months).

It still doesn't make sense why that would be lower though.  And without being able to see your tax return, unfortunately I can't really figure that out for you.
