Is an Individual HSA eligible for withdrawals for the benefit of spouse or dependent?

My husband had an Individual HSA with a previous employer before we were married or had children. Neither of us now have a High Deductible plan now, but there is still a balance in his HSA and he rarely goes to the doctor. Can the funds in the HSA be used for any of my medical expenses or those for our daughter? since he did not have a family plan?

Is an Individual HSA eligible for withdrawals for the benefit of spouse or dependent?

Yes, distributions from his HSA can be used to cover any qualified medical expenses incurred by you, as his spouse, or his dependent after the date on which his HSA was established.  Regarding your own medical expenses, only expenses incurred while you are his spouse are qualified expenses for the purpose of a distribution from his HSA.  Having an HDHP plan is only a requirement for making contributions to an HSA, not for receiving distributions from an HSA.
