hi,
I have a situation that I'm unsure how go about it. here is the situation:
My son is on a F-1 student visa since late 2021, and he is 25 years old. He is not a green card holder but has a ITIN number.
I paid for all his college expenses( e.g. room, board and all college tuition) for 2022. I file my return with my husband, whose is a citizen and I'm a green holder. can I claim the education expenses on our return? Thanks

No.
Your son on a F1 visa since 2021 is a nonresident alien and is not eligible for education credits.
Please see Question 24 of this IRS document.
thanks for the quick reply.
I'm saying can i claim the education expense on my return?
No. You cannot claim his education credits on your tax return as he is not eligible.
