Damaged Personal Property

A vehicle slammed repeatedly into our residence repeatedly.  The driver was uninsured. I am a renter.  We weren’t provided help from the landlord initially, and I paid thousands in hotel expenses until new housing could be located.  Six months later when we moved back in, I had to replace rugs, bedding, window hardware, air conditioners, etc.   I also had to hire cleaning companies because the construction left dust and debris all over the place that the landlord also didn’t take care of.  My renters insurance wouldn’t pay because it was considered a willful act (she backed up repeatedly into the building trying to get away).  Is any of this deductible?  From what I read, it isn’t because I’m not part of a Federally declared disaster.  It would be nice if I was mistaken because it has been financially devastating.  Thank you.

That is dreadful.  And ....sorry....but none of that is deductible on your federal tax return since it was not a loss in a federally declared disaster area.   Do you have enough information to take the person to court and sue for the damages?
