Working in MO and staying in KS. How to avoid double tax ?

Also, is 260  number of  work days that Missouri considers in a year when we allocate % as to work from home in Kansas vs at my work facility in Missouri?

You are not a resident of Missouri (MO) if you do not live there even if you work there.   If you track the days you actually work in the MO facility you will use those days divided by total days worked to arrive at the amount that would be taxable to MO.

If a nonresident employee performs all of his or her services outside of Missouri, the wages paid to that employee are not subject to Missouri withholding. For additional information, refer to the Individual Income Tax FAQs web page.  The answer is no in this situation.

If you do pay tax to MO on a portion of your income, then you will receive a credit for taxes paid to another state on your Kansas (KS) return.  Be sure to complete your nonresident state first and then your resident state so that TurboTax can carry the credit over for you.

The credit for taxes paid to another state on the same income is used on your resident state because they do not want you to pay taxes twice on the same income.  As the resident state all worldwide income must be included.

The credit for tax paid to another state on the same income will be the lesser of:

  1. the tax liability actually charged by the nonresident state, OR
  2. the tax liability that would have been charged by your resident state
