Worked Remotely for 4 months in another state - do I have to file a non-residency form for that state?

I lived in NY and eventually moved to Georgia.  My W2 has both NY and GA incomes - while receiving Money from NY I worked remotely in Indiana for 4 months. I already filed my state returns for NY and GA and realized I should go back and file a non residency for Indiana.. but now I'm not sure as I did not earn income from Indiana sources but just for New York + GA. I think I would only have to amend my NY return? 

 

This is what is listed for Indiana Non residency "Nonresidents: Individuals who are legal resident of another state(s) and had income from Indiana must file Form IT-40PNR, Part-Year Resident or Nonresident Individual Income Tax Return."

 

I do not think that applies to me?

I assume you meant you were physically in Indiana for four months working for a NY company.  If that is the case the full year non-resident Indiana return would apply to you. 

 

From page 8 in the IN form instructions:  

 

Indiana income includes income from the following sources:

 

1. Winnings from Indiana riverboats, pari-mutuel wagering, and lotteries;

2. Labor or services performed in Indiana, including salaries, wages, tips, commissions, etc.;

 

In the "My Info" section you would scroll down to the "Other State Income" topic and answer "Yes" and select "IN" from the dropdown.  This will generate a non-resident return.  

 

I also assume the income earned from NY while in IN was already filed on your NY return.  Since you were a resident of NY during that time they would be taxing you on all income from all sources.  Therefore to mitigate the double taxation, you also can amend your NY return to claim a credit for taxes paid to another state, in this case IN. 

 

At the end of the IN return take note of the amount of income and the taxes paid on that income to IN.  You will use those numbers in your NY return to claim the credit.
