My wife and I got married on 1/3/2024. We are both retired and live in NC for all of 2024. She lived in DC in 2023 and did not update her address to NC for 2024. She did not pay any DC income tax for 2024 but have Pension and SSS income. Her 1099 still has the DC address for both pension and ssa. I am trying to determine whether she has to file a DC tax return since she lived in NC the full year and paid not DC income taxes. Our goal is to file in NC as married filing joint for both the federal and NC tax return. Would like understand if my assumption of not filing a DC tax return is correct and if not what should we be considering?

Yes, you would not have to file a DC return if she moved to North Carolina on January 3, 2024 with the intention of making North Carolina her domicile or resident state. If you have not already done so, be sure to update her address. Congratulations!
