Turbotax State of Residence: Moved Domicile But Not Yet Met Tax Residency Requirements

I moved from Illinois to Florida at the end of July last year. I have a domicile in Florida and no longer have a domicile in Illinois. However, I have not yet lived long enough in Florida (183 days) nor completed other requirements necessary to establish tax residency in Florida (though I intend to do so next year).

 

I am currently unemployed and have only investment income (eg. dividends, interest, capital gains) throughout the year.

 

Should I complete my taxes in Turbotax and allocate investment income as…

  • full-year resident of IL?
  • part-year resident of IL until July and resident of no state for the rest of the year?
  • part-year resident of IL until July  and part-year resident of FL for the rest of the year?

Florida has no state income tax, so you have no state return to worry about with Florida.   You need to file a federal tax return and a part-year return for the state of IL.

FLORIDA

 

Florida does not have a state income tax.   You should have skipped the FL tax unless you own rental property  in FL or a FL based business.

Florida has a  tangible personal property tax form that is used in a Florida-located business or rental property and is filed with the county property appraiser by April 1st. 

If you do need to file a Form DR-405, nothing will print (except an instruction sheet) unless assets were transferred or you manually entered assets in the DR-405 worksheet. 

If you do not have tangible personal property to report, choose   Skip State   in the   State Taxes   section.

I do not have personal property in FL. So just to confirm, there is an allocation of investment income for part of the year to FL even though I haven't yet met the tax residency requirements for FL (eg. living in FL for 183 days)?
