You do file the nonresident return. However, you will come to a screen entitled Maryland Wage Income. You will have a box asking you to input your wages from Maryland sources. Type a 0 in this box and your Maryland taxes mistakenly withheld will be refunded.
Keep in mind that Maryland may ask for proof, so be prepared to respond to any correspondence with proof that the Maryland tax withheld was a mistake and you are entitled to a refund.
