The following 414(h) retirement contributions shown on federal form W-2, Wage and Tax Statement, are taxable by New York State. If the contributions are for one of the plans below, use New York IRC 414(h) Subject to NY tax. This will transfer the amounts to your NY tax return, Form IT-201 or Form IT-203, as required by the state of New York.
If the contributions are not to one of the plans above, use New York IRC 414(h) NY Tax Exempt. The amounts will not be transferred to your NY return.

I am not a NY state or local employee but it will not accept NY IRC 414(h) tax exempt, or any thing else besides NY IRC 414(h) Subject to NY Tax.
As a non NY state or local employee shouldn’t my medical, dental, vision and FSA contributions be deductible?
Section 414(h) is for retirement contributions. Medical, dental, vision, and FSA contributions would be section 125. These amounts are not subject to federal income tax but are subject to state tax so will need to be added back to income - choose subject to tax.
