The only way that you can be charged for an excess Roth contribution if you had no earned income to report on your tax return. You must have earned income in excess of $150 to be able to make a Roth contribution.

I got married in November 2023 to my wife who lived overseas. We are filing taxes jointly for 2023 and treating her as “Nonresident Spouse Treated as a Resident". However, California is charging us a penalty for her not having insurance
