My husband's military retirement qualifies for Bailey as he served from '79-'01. What about his local law enforcement retirement '01-'17?

Bailey only covers retirement benefits if the retiree was vested in the particular retirement system as of August 12, 1989. See page 25 of this reference: https://files.nc.gov/ncdor/documents/files/income2016bulletins.pdf
