If I receive money from a military allotment as part of my divorce decree for 50% of my husband's military retirement is that income

if I receive money from a military allotment as part of my divorce decree for 50% of my husband's military retirement do I count that as income even though I do not get a 1099 or anything else.  The husband's  military retirement is taxed but I receive $400.00 tax free should I include this as income

Yes, your share of the ex-husband's military retirement pay is taxable income for you, even though no tax is withheld for you by DFAS.

His retirement income is taxable income for him, so any portion he must send to you is taxable to you (and deductible for him).

Report this income on Line 21 with the description, “Nominee Distribution from (ex-husband's initials or SSN)" using the following menu path:

  1. Federal Taxes
  2. Wages & Income
  3. Less Common Income
  4. Miscellaneous Income
  5. Start
  6. Other Reportable Income
  7. Start
  8. Other Taxable Income
  9. Description = “Nominee Distribution from (ex-husband's initials or SSN)" 
  10. Amount = $xxx
