Who are you paying the rent to - your husband or the party he is buying the the house from?

 

If you are paying rent to your husband and claiming the payments for purposes of a Renters Credit, then you probably cannot claim the payments. It will depend on the laws of the state where you live, but payments to a spouse for purposes of a Renters Tax Credit almost certainly do not qualify as "rent".

 

If you are paying it to the party he is purchasing the house from, then you probably can claim the payments.
