In most cases, the person receiving your property isn't the same that that is giving you their property. That is why most cases need a third-party intermediary (which also allows timing differences). But in your case, it sounds like the person receiving your property is the same person that is giving you their property, in which case a third-party intermediary may not be needed. I suggest that you go to a good tax professional to look at the situation, as well as to advise you of anything else that may apply to you.

I am a US citizen/resident, do taxes in USA only. My wife is Canadian/resident, does taxes in Canada and USA. I treat her as a resident alien and file married filing jointly. We are looking into buying a property in Canada, but because of tax laws (Speculation tax) will have to buy the property under a Canadian family member. If I move a large amount of legal money from USA to Canada to my wife's checking account, does this trigger any taxes or anything I have to report to the IRS. I am asking strictly from USD cash to CAD checking account, all investments (i.e stocks) will have been sold and taxes already will be paid on gains. It looks like Canada has no issues with it, no gift tax, though I am technically not gifting it to my wife.

I successfully e filed four Federal returns this spring. A fifth return was rejected and had to be mailed in. Today, I attempted to e file a fifth return for another friend (while late, he was getting a refund) and the attempt was rejected with msg that 5 free e files had already been used. The only possible explanation was that earlier failed attempt was indeed counted towards the five free filings.

It means that you do not have to collect sales tax on sales to customers in New Hampshire. Being in a state that does not have sales tax has no effect on your obligation to collect sales tax on sales to customers in other states. Sales tax is charged at the location where the product is delivered, not where the seller is located.

Yes, that's true. The thresholds are different for each state.

The requirements are different for each state. If you do have to collect and remit sales tax in a particular state, you are generally required to register with that state.
We haven't even touched on the issue of determining the correct sales tax rate for each location that you deliver a product to. In many states, the sales tax rate is not the same for the whole state. There are local sales taxes that vary depending on the specific location. A particular item might be taxable in some states and not in others. So you have to answer three questions for each sale.
Are you required to collect sales tax for the state that the product is shipped to?
Is the product taxable in the state that you ship it to?
What is the sales tax rate at the location that the product is delivered to?
All of these complications are the reason that you need to rely on an outside service to handle sales tax for you.

I want to have a standalone online shop and I have a few questions about how I handle state sales tax. I am only selling from a state that does not have sales tax (NH). What does this mean for me? I do not have a very high volume of sales at this point I have heard I need to have "nexus" in a state before I even have to worry about submitting/filing anything. Is that true? It also appears that the property to be relinquished and the replacement property have the same FMV and there doesn't appear as if there will be any boot. @rab77 may want to contact a local intermediary (QI), however, to facilitate the exchange of the deeds.

Financial institution won't release/distribute the 401K to the minor beneficiary until the minor turns 18, so no one will have access to the account for several years. What are the implications for RMD's and associated income tax on those RMD's when there is no access to the account in order to actually transact the RMD's? At this point, technically the financial institution won't even tell me (the minor's parent) what the 401K account balance is, though I can probably approximate it's value from other available information.

I won a civil suit. I hired a surveyor to short plat my property to sell off a portion. The surveyor put the final boundary line in the wrong spot. It was far too close to my shop making it virtually unusable because the doors are now too close to the boundary line. I sued in the amount it would cost to rebuild a new shop to a new location further from the line. When he pays me the amount I was awarded, is this taxable income? Seems like it shouldn't be because the amount awarded was to fix the problem he caused. And if it is taxed, I wouldn't have enough money left to address the issue. Not to mention the $30k it cost me to litigate it.

The IRS is concerned with your federal tax, not your state tax. So....are you having an issue with your state tax return? When you filed your federal return did you e-file state at the same time? Were both returns accepted?
When you e-file your return you will get two emails from TurboTax. The first one will say your return has been transmitted; the second one will tell you the IRS has accepted or rejected your federal e-file. If you filed a state return, there will be a third email (usually a day or two later) that tells you if the state e-file was accepted or rejected.
