Selling a home in California. One owner clearly meets the "principal residence" exemption from California withholding (as well as exclusion of up to $250K gain from taxable income) on the sale proceeds per IRC Sec 21 (lived in home as primary residence for at least 2 of the last 5 years). However, another owner moved out 6 years in the past. They definitely do not qualify for the exclusion of gain per IRC 121, BUT do they still qualify for exemption from California 593 withholding at the time of sale? CA FTB Guidelines read: Property Last Used as a Principal Residence You qualify for a withholding exemption if you last used the property as your principal residence without regard to the two-year time period (for withholding purposes only). The other owner's last use of the property was definitely as their principal residence -- they did not rent back or otherwise use the home. They did, however, use the CA 593 exemption from withholding and the IRC 121 exclusion of gain on the sale of a different home in the intervening 6 years. Searches of the web do not provide a clear answer for this scenario. If they do qualify for the withholding exemption, why then does the FTB even bother with detailing the first exemption for a principal residence if used for 2 years within the last 5 years before sale (because that would be subsumed by the exemption, "Last Used as a Principal Residence")?

If the return is accepted you will have to amend your original tax return. An amended return, Form 1040-X, can only be printed and mailed to the IRS if the original tax return was not e-filed. The IRS will take up to 20 weeks or longer to process an amended tax return.
Before starting to amend the tax return, wait for the tax refund to be received or the taxes due to be paid and processed by the IRS.

Why did your website not specify I needed Windows 11 before I downloaded it? It wasn't until that point it stated the requirements of 11. I couldn't speak to anyone and ask them if I can transfer that license code to my Mac. Now I had to buy a Windows 11 laptop just to run this software. If I hadn't been using TurboTax over a decade, I'd probably told you where to stick it and gotten a refund on the charges.

I just filed this morning and then checked my mail and saw I had a W-2 from a previous employer for some on the very last wages earned. It’s less than $4K and will not put me in a different bracket. I do not owe and if anything this income will increase my refund by a few dollars. Should I amend now or wait until after I get my refund? I don’t want to delay my refund.

This worked for me - Open TT2024 and do the software upgrade Load the 2024 return in TT2024 and then resave it Close and reopen TT2025 After doing the above steps TT2025 recognized the 2024 file.

If you are using the TurboTax desktop editions installed on a personal computer, you can use any of the desktop editions to report the sale - https://turbotax.intuit.com/personal-taxes/compare/desktop/
If you sold your primary personal residence and you lived in and owned the home for at least two years in the five year period on the date of sale, you do not have to report the sale if your gains are less then the exclusion amounts of $250,000 if filing Single or $500,000 if filing Married Filing Jointly (and both lived in the home for two years).
Gain or Loss = Sales Price minus Sales Expenses minus Adjusted Basis (Purchase Price plus the cost of improvements prior to the sale)
Selling cost can include escrow fees, legal fees, real estate agent commissions, advertising costs, and even home staging fees.
If you had a gain greater then the exclusion amounts then you would have to report the sale. Also, if you received a Form 1099-S for the sale either with a gain or a loss, the sale has to be reported. You will need the online TurboTax Premium edition to report the sale if you are using the online editions. Make sure that you indicate that you want the sale of the home reported on your tax return.
