I transfered my GI BIll education benifits to my child and they are attending university this year using those benifits. Am I eleigable to file for the AOTC?

It depends.  You would only be able to claim the AOTC if you paid for some of your child's education.  If the GI Bill paid for all of the tuition and fees, you would not be able to claim the AOTC.  If the GI Bill only covered a portion of the tuition and fees, you can claim the AOTC for the amount not covered by the GI Bill.  

 

Qualifications for claiming the American Opportunity Tax Credit are:

  • You paid an eligible student's qualified education expenses for higher education at any college, university, or vocational school with a student aid program administered by the US Department of Education.
  • The eligible student is you, your spouse, or a dependent on your return.
  • For the full credit, your MAGI (modified adjusted gross income) is less than $90,000 ($180,000 if you're filing jointly).
