Tax Year Prior to 2020: How do I know if student loans will take my tax refund?

You can contact the agency with which you have a debt to determine if your debt was submitted for a tax refund offset or you may call BFS's TOP call center at (800) 304-3107. You can enter your SSN in the automated system and it will tell you if you have an offset outstanding for your SSN. If your debt was submitted for offset, BFS will reduce your refund as needed to pay off the debt and send it to the agency you owe. Any portion of your remaining refund after offset is issued in a check or direct deposited as originally requested on the return.

I have a debt of $2900 to nys unemployment. My refund is in the area of $6000. Will they just take the debt I owe or will they take my whole refund then send me a check of the overpayment? Should I expect the remainder of my return to still come in as normal?

I am no longer in student loan default and the call center says it is showing no pending dedaults. Does this mean I can safely file my faxes and not have them taken?

Not helpful because in my search I asked about a specific state. I got a generic answer.

If your Student Loans are in Default, and your Lender has submitted them to the Dept. of Education, they may take your tax refund to pay towards your loan balance.

 

Call 800-304-3107 and use the Automated System to see if you have a tax refund offset.

 

If your loans are still with your Lender, you can contact them to work out a payment plan so that your tax refunds will not be affected.

You will not know for sure if your refund will be taken, but if it has been taken in the past and your debt has not been satisfied, then chances are good that it will still be taken.  To know for sure, you should contact the agency to which you owe the debt for more information.

What if I have been making payments but they still take my refund? Is there anything I can do because I called last month and was told as long as I was making payments, I would still get my refund.

Again, it depends.

 

The only way to know is to do what AnnetteB6 mentioned before and contact the agency where the debt is from.

When I call that number it says I have no non tax debts. But I know I still have student loans. Will they still take my refund?

Well, it looks like your student loan provider hasn't reported it yet to the government

 

If your refund is offset for student loans you will receive a letter from the IRS about it. You can check to see if there is an order to offset your refund.

 

 NOTE: You can contact the IRS Treasury Offset Program Call Center at 1-800-304-3107 to ask if they have an offset for you on file. TurboTax would not have that information.
