American opportunity Credit - Undergrad and Grad Student in 2020

My daughter finished undergrad in March 2020.  All tuition for undergrad was paid for in 2019.  We did not receive a 1098-T from the University.  She was a dependent in 2019 and we never qualified for any education credits.

She entered grad school in 2021 and she is no longer a dependent.  We have a 1098-T for Grad School.   If I answer the question in the software, it applies the American Opportunity Credit as the largest credit.  This is because we can answer "no" to "had you earned four years of college credit before 2020".  

It doesn't seem right that she would be eligible for that credit given she didn't have any undergrad tuition in 2020 but perhaps that's not the rule.  Should I manually change that to apply the Lifetime learning credit instead?  The AOC credit is $1000 more so I'd obviously like to take that if she is eligible.

You are correct, you cannot claim the AOTC based on her grad school tuition.  The simple solution is answer YES " to "had you earned four years of college credit before 2020".  Lying to TurboTax to get it to do what you want does not constitute lying to the IRS.
