2016 tax year, IRS proposed changes. Education credits, line 50 My wife was in grad school that year. They want $2000 plus interest. What should I do?

I have the receipts of tuition now.
I'm not sure I attached it with the tax form.

Did you receive a letter?

If you receive a letter or are audited by the IRS, it may be because the IRS did not receive a Form 1098-T, Tuition Statement, verifying the student’s enrollment. Or, we need additional information to support the amounts of qualified expenses you reported on Form 8863. Review your Form 1098-T to make sure the student’s name and social security number are correct. If they do not match, contact the school to correct the information for future 1098-T reporting. If the student should have and did not receive the Form 1098-T, contact the school for a copy. Note: There are a few exceptions in which educational institutions are not required to furnish Form 1098-Ts. For details please see “What is Form 1098-T, Tuition Statement and how do I get it?”

If you claimed expenses that were not reported on the Form 1098-T in Box 1 as amounts paid or if your school reported the amount you were charged for qualified expenses in Box 2, please send us copies of paid receipts, cancelled checks or other documents as proof. See your letter for further instructions for what documents to send. If you do not have the letter, see our page Forms 886 May Help You for the Forms 886-H-AOC and 886-H-AOC-MAX for examples. Audit and examination process

IRS selects income tax returns for examination identified by computer programs showing a return has incorrect amounts. The examination may or may not result in a change to your tax or credits.

The IRS has begun cracking down on schools that send out a 1098-T with box 1 blank. They are not always accepting an amount in box 2, of a 1098-T, as proof that you paid tuition. There was no additional proof required at the time you filed your return (so you did not and could not have attached your tuition receipt to the forms). . The IRS wants the proof , now, after the fact. TurboTax did nothing wrong.  There was nothing you could do to prevent this. This is a failure of the tax system. The school could have done a better job with the 1098-T, but even that statement is an oversimplification. You only need to prove you actually paid tuition, with school statements and cancelled checks and/or bank or credit card statements.

Thank you very much. We asked the university, they don't have a 1098-T since they didn't have a SSN for her on file. So we can mail them the statements. Would that be enough? Would we need an tax adviser for this?

No 1098-T? Is this an accredited US graduate school?

Actually, it's not clear. The IRS usually requires a 1098-T or a standard reason why a 1098-T was not issued. But, if it was me, I would send them the tuition statements and see if they accept them.

 Why doesn't the school have the student's SS#. That is something you should get corrected. Is she not a US citizen?

We are not citizens. We were filing as resident alien.

You are eligible for the education credit if you both  were resident aliens for the entire tax year.
