According to the New Jersey Division of Taxation, a partnership is required to file a tax return if it receives income sourced in New Jersey or has partners who reside in New Jersey. Otherwise, no tax return is required.
Got it. The money was invested in an LLC in NJ. My LLC is not involved in any business related activity in NJ. Do I still need to file NJ partnership form after I receive the income from the investment in that LLC in NJ? For my multi member LLC, only me and my wife are partners. We do not have any partner from NJ.
the rental real estate is sourced to NJ so you should be filing a partnership return there and also a nonrsident 1040
I see. So what I understood for now is as in 2024 I did not have any partner in NJ and no income in NJ, this year, I do not need to file anything this year but as I will have income in 2025, next year, I need to file PA partnership return (as my LLC is registered in PA), NJ partnership return (as income from NJ LLC) and nonresident 1040 for NJ, correct?
