My spouse and I are divorcing. In 2019 we filed jointly received both stimulus payments in 2020, which we split down the middle per our attorney's advice. In 2020 we did not live together after March 2020. This year I filed HOH. Since he is paying spousal support we could not file jointly plus it's time to sever financial ties since he does not live with me. I just found out he has not filed taxes for 2020, has not changed his address with the IRS (even though I provided him the paperwork to do so early 2020.) I am now seeing a deposit will be made into my personal bank account this week and also the joint account we kept open (for life insurance payment debits until divorce is final) on the same day. My question is, if a $2800 payment goes into the joint account based on the 2019 return we filed jointly and a $1400 payment goes into my personal account based on my 2020 return is there a way to return the $1400 overpayment to the IRS? I know I am jumping the gun - but I am hearing instances of this happening to separated couples. I am hoping for the best but the only return the IRS has for my soon to be ex spouse is from 2019 when we last filed a joint return. Any advice would be great. Thanks
