There is no need to return the check at this point. Congress has not included any provisions in the CARES Act to clawback (reclaim) any stimulus payments that were sent in error. The stimulus is actually an advance on a credit on the 2020 return, but there are no plans to make people pay pack the stimulus checks. If you are concerned, you can always set the money aside while we await guidance from the IRS on these erroneous payments from the IRS. Alternatively, you can call the IRS at 800 829 1040 when they reopen.
