I filed as an independent by accident and I'm dependent. However, I just received my stimulus check.

(1) and (2) Can you file and receive the stimulus? Could I potentially be independent?

 

It seems to that that there are two issues related to the tests for a qualifying child.

  • Were you a full-time student for at least five months in 2020? and
  • Did you provide more than half of your own support during the year?

I do not know whether you meet the 'student' test.

 

A child who provides over half of his/her support cannot be claimed as a dependent on the parent's tax return.  You may want to review an IRS Worksheet for Determining Support.  To see this worksheet, click on IRS Publication 501.  Then go to the index at the very bottom of the document and click on the worksheet listed under 'W'.

 

(3) If your 2020 Federal tax return has been accepted, you will not be able to amend the tax return earlier than March when the amendment form becomes available.

 

(4)  If your 2020 Federal tax return has been accepted, you absolutely want to wait until you receive the refund.  It is always possible that the IRS will not issue the stimulus payments or have another issue with your tax return.

 

(5) If you amend a 2020 Federal tax return, it is possible that a portion of the refund will have to be returned.  In years past, you would write a check or mail a money order with your paper-filed 1040X.  Procedures may be different this year if e-filing of amended tax returns is permitted.

 

(6) I do not know that you are a dependent as a qualifying child.  I do not know whether you made a mistake or not.  I include the tests below one more time.

 

Finally, make sure that you follow the TurboTax COVID Tax Center and IRS Economic Impact Payment Information Center for updates from the IRS.  

 

 

A dependent must meet the requirements of a qualifying child or a qualifying relative in order to be claimed on a tax return.  The tests for a qualifying child are:

  • Relationship: Must be your child, adopted child, foster child, brother or sister, or a descendant of one of these (grand or nephew).
  • Residence: Must have the same residence for more than half the year.
  • Age: Must be under age 19 or under 24 and a full-time student for at least 5 months. They can be any age if they are totally and permanently disabled.
  • Support: Must not have provided more than half of their own support during the year.
  • Joint Support: The child cannot file a joint return for the year.

I filed as an independent by accident and I'm dependent. However, I just received my stimulus check.

What form does the dependent need to use to amend/fix their status? My son accidentally forgot to check the box indicating that he is a dependent. Now he needs to fix that because he is a full-time student and can be claimed as my dependent. There does not appear to be a box on the 1040X that he can use to change his status. What form do we use?

Make the change in the Personal Info in TurboTax and it will carry over to the revised Form 1040 that will be filed along with Form 1040X @oops12 

 

Fill in the Explanation of Changes to tell the IRS why you are amending.

 

If you have a state tax, you may have to amend your state return as well.
