My partner did this, this year. Does he file his amendment before getting refunded, it's already been accepted, or after? And if I file mine and mail them off will that prolong me getting my refund? Will he still get his refund he would have gotten without the kids direct deposited or by mail check now?
You will need to print and mail your return. At some point the IRS will contact both of you to determine who gets to claim the dependents. It could take up to a year for that to happen.
Your partner should not attempt to file an amended return until the original return has been processed by the IRS. See this help article for more information.
In the meantime, if you e-file a return that includes a child already claimed on another return, your return will be rejected from e-filing.
You can, instead, as suggested by @taxlady28, print and mail your return with the correct dependent(s). When the IRS detects that the same dependent has been claimed on more than one return, they will typically issue audit notices to both taxpayers and request documentation to establish which taxpayer is entitled to the dependent.
