Forgot to attach 1099b to 8453 (only included 8949)

Hi,

I e-filed my federal tax return and TT asked me to send 8453 form along with 8949 form, but I read in another article that I need to also send 1099b. Do I need to re-send 8453 with 1099b? Should I intercept the package (it ‘s still in transit ) to avoid confusion? My 8949 has box b and box e checked

Forgot to attach 1099b to 8453 (only included 8949)

If your Form 8949 has Box B (short-term transactions reported on Form 1099-B, with basis reported to the IRS) and Box E (long-term transactions reported on Form 1099-B, with basis reported to the IRS) checked, you generally don't need to send your Form 1099-B along with Form 8453. The details from your 1099-B are already reflected in Form 8949, which is sufficient for the IRS.

 

Once your return has been transmitted, it can't be interrupted unless the return is rejected. Most likely, TurboTax guided you correctly in having you send only Forms 8453 and 8949. ‌However, if the IRS needs your 1099 B, they will inform you that it needs to be sent. You can send it in then if they request it. .

However, box b is short term transaction reported on 1099b showing  basis wasnt reported to irs and same with

 

box e: Long-term transactions reported on Form(s) 1099-B showing basis wasn't reported to the IRS

 

8949 has just a summary one line showing total basis.

If you feel you would like to send the 1099-B with the 8949 and 8453 you can always include it, even if it's not required. The forms should be mailed within three days of your return acceptance at the IRS.

 

If you are e-filing your tax return, then mail your statements and Form 8949 (1099-Bs or other document showing detailed sales information) along with Form 8453 to: 

 

Internal Revenue Service

Attn: Shipping and Receiving, 0254 

Receipt and Control Branch 

Austin, TX 73344-0254

 

If you need a blank Form 8453, you can download this pdf, enter your address information and check the box for Form 8949 (this form is really just a cover sheet).

Will there be an issue if there is duplicate submission of form 8453? I am asking because I have already sent 8453 without 1099b.

There may be problems with a duplicate submission but there may also be problems with not submitting the proper form.

 

Whether you prepare a second mailing or not, retain copies of all the proper paperwork with your tax return file should a tax authority contact you at a later time.
