Capital loss Carry over from late filing on prior years

Hi,

I was late in filing my 2022 return but i filed my 2023 return on time.

 

I had a $28k loss in the 2022 return, but did not have the correct carry over on my 2023 return.

 

I understand I need to file an amended 2023 return to get the correct carry over amount.

 

Do I need to wait for the 2023 amended return to be accepted before I enter the total carryover on my 2024 return?  Or can I go ahead and use the corrected carryover loss on my 2024 return? 

 

For example, if my 2022 return carryover loss was $28k, and my 2023 return was $5k, should I go ahead and bring $33k into my 2024 return or do I have to wait for the 2023 amendment to be accepted first?

You definitely should wait until your amended return is accepted before you file 2024 return.  Otherwise you may get a letter saying there are discrepancies on your 2024 return.  Make sure you file an extension if your 2023 amended return has not been accepted before April 15.
