I have back owed debt and so does my husband. Can we both file under injured spouse or can only one person do that? We have 2 dependents, so I'm trying to get the most we can back.

Injured Spouse possibilities: The only thing I might add for you is that if one of you has a low debt balance that would be paid in full with your refund with some money left over, that person could file the injured spouse. This is only if one of you has a very low amount of debt and it is not federal tax. Child support is a good example.

No, you cannot both file injured spouse. If you both owe for previous taxes, student loans, etc. injured spouse does not do any good at all. if your refund is subject to being seized, it will be seized, whether you have dependents or not. Sorry.
