Why is Turbo Tax not using the adjusted income for Earn Income Credit as stated under the IRS regulation

TurboTax follows all of the tax laws regarding earned income credit.  Please use this IRS tool to gain a better understanding of the amount of EIC you are getting.

If you are eligible for earned income credit, it is added to line 27 of your Form 1040 automatically when you enter your income earned from working and the information for your dependents, plus any of the other relevant information such as investment income, other forms of income received, etc.
