Was the money from a lawsuit settlement considered back wages?

I had received a 1099-MISC from Keller Lenkner LLC. The customer service said that Postmates had "missclassified workers as independent contractors". Turbotax asks if lawsuit settlements are back wages or not. I called the Keller Lenker customer service and they said to ask a professional tax preparer. Does anyone know if the settlement is considered back wages?

TurboTax chat said a W-2 would make the wages back wages. So, I do not owe any back wages.

I did contact a tax preparer, the company sued, the lawyers (who told me that they do not offer tax help), and H&R Block. TurboTax's chat is what helped me finally answer this question. The company sued didn't contact me yet in a more timely manner yet.

No, only the agent representing Postmates or Postmates can answer the question is the 1099-MISC for back wages.  You should re-contact them again and when they advise you what the 1099-MISC  is for TurboTax can assist you in properly preparing your tax return.

 

This issue may not be resolved in time for you to file your taxes by the April 18, 2022 deadline.  You may want to consider filing an extension to file you’re your tax return.  This TurboTax link How do I file an IRS extension (Form 4868) in TurboTax Online? will assist you in filing an extension.

 

Keep in mind: An extension doesn't give you extra time to pay your taxes — but it will keep you from getting a late filing penalty.
