unmarried filing jointly

unless you live or have lived in a state that recognized your cohabitation as a common-law marriage you can not file jointly. Filing jointly when you are not legally married is a serious violation of the tax laws.

if you don't file jointly, one of you can claim the child and thus file as head of household. the other must file as single.
