Hi I'm a TN visa worker, can I file my tax return as married filing separately so that my spouse does not have to file for ITIN?
My spouse does not generate income so I would assume it is the same if I either file as filing jointly or separately. Am I correct?
Thank you in advance!

Yes, that is correct. Be sure to indicate in your return that your wife is a non-resident alien when select that you are filing Married Filing Separately in the my info section of the return so that it won't ask what her Social Security number or ITIN is.
Here is a snapshot what that screen looks like.

Many thanks for your confirmation Dave!
Hi Dave,
I just noticed this selection comes up after the system asks for spouse information, so it is still asking for SSN. Did I miss anything?
Or should I proceed like this and instead of e-filing I must do it on the mail?
Thank you again.
You can keep ignoring the error message about the SSN and E-file your return.
If this does not work for you, post back and we will investigate further.
Hi Patti,
I've got to the last step but it is not allowing me to e-file if my spouse does not have SSN information on the form. It only gives the alternative to file by mail.
Is there an alternative way to fill up that field on the form? Or I must do it by mail?
Yes, unfortunately, you must file by mail since the form will not be able to be e-filed.
