Our son lived with us until Labor Day, then moved up to Michigan.  He has an HSA as part of his insurance with his new job.  Because he lived with us for more than 1/2 the year, we were going to claim him as a dependent but there seems to be a problem with him filling out his taxes because of the HSA and being claimed as a dependent

As a dependent on someone else's tax return your son is not eligible to contribute to an HSA.  So he will be taxed on any HSA contributions that he made if you are claiming him.
