Right to Claim as a Dependent-Has the other parent waived their legal right to you so you can claim her as a dependent on your return this year?

Sorry again for the confusion. 

 

The reason why I replied to the message was to show the missing screenshot and show the questions that followed each screen after answering the interview questions in my previous message.

My original question for this thread was how to answer the following questions:

 

  1. Has the other parent waived their legal right to you so you can claim her as a dependent on your return this year?
  2. Do I need to fill out a Form 8332?

In the thread I believe question number 2 was answered, I don't need to fill out a Form 8332 because the form is for custodial divorced or separated parent who relinquishes the tax benefit for the dependent to a noncustodial parent.  We are not married and live together with both daughters. 

 

Question number 1 in the screenshots I provided if I answer no, it appears that my partner is unable to get the child tax credit of $2,000 but if I answer yes, then she gets the tax credit.

 

Is my partner able to get the tax credit of $2,000 if she files single and uses one of our daughters as dependent?

I am not adding the same daughter to my tax returns as a dependent, which I am filing head of household. 

 

If she is able to get the tax credit then I believe I need to answer Yes to my original question, has the other parent waived their right to you so you can claim her as a dependent or should I answer the questions differently?

If your partner files as Single with one dependent, she can get the Child Tax Credit if eligible.

 

If you file as Head of Household with a dependent (different than the one your partner claims), you can say NO, to 'other parent waived', since you are also the parent and don't require a Waiver from a custodial parent in your case.

If my partner answers no, she will not be receiving the tax credit. 

The question was not asked when I filed as head of household it only came up with my partners filing single.

When you get to the question about Living Situation, don't choose equal nights -  choose the parent that is claiming her.   The next screen will ask if you are allowing the other parent to claim the daughter - answer NO.   Then NO, a relative did not help.    Otherwise, you are going to end up paper filing with a Form 8332 that you do not need.
