@tyle125036  It depends.  The real question is whether you qualify by IRS rules to file as an independent.  If last year you were a college student, and were younger than 24 years of age, living "on your own" does not matter:  you are considered to still be living with your parents.  So you would only qualify as an independent if you are not providing at least 50% of your own support; that support does not have to come from your parents.  (For instance, a scholarship, provided by the school, is not support that you provided, so that would lean you towards being a dependent if that's the case).  If you qualify to be a dependent, then you must mark that someone may claim you as a dependent, even if they don't.  (And if they didn't, and could have, they would do well to amend their return).

 

However, if you are an independent by IRS law, then you absolutely should claim the Recovery Rebate Credit.  It was nice of your parents to give you some of the money, but (based on 2019 stimulus laws), they did not get any amounts off of you (unless you were under 17 last year).  And even if they did, if you are now legally able to claim yourself as an independent, you will be able to claim the credit anyways.  In the interview you will simply state that you did not receive any of the stimulus, and the rest will be calculated out for you.  The IRS will likely verify that it is a legitimate claim, but if you are entitled to receive it, you will.

Well, it was nice of your parents to do that, as they were not required to give you anything.. Did you still qualify as a dependent in 2020?

They received all of the payments addressed to them. However now that i live on my own they decided to give me some of the most recent stimulus.

they did not claim me in their 2020 return
