Offset Reversal (Injured Spouse)

Filed 8379 and the form was processed and close and the new amount was given to me on what was going to be given to me since I am the injured spouse.  The refund had already been offset and sent to the agency with the debt.  Do I have to wait for the agency to return the money?  Or is this still coming from the IRS?  This is for Texas OAG and I was unsure on the length of time they have to do this.  Or can they hold my money hostage for as along as they want?
