When you claim her on your 2021 return you will report that you received no advanced child credit and will receive the full amount. He might have to repay all or some of what he received depending on his income.

the IRS says only the custodial parent (despite what might be agreed to in a divorce or separation agreement) is qualified to claim their child unless the custodial parent furnished a signed form 8332 to the other parent.
however, if there is a court order specifying who can claim the child each year, ignoring it will cause legal problems if the other parent pursues the issue.
Question- Do I have to turn this form 8332 in with my tax forms? Since one has never been done?
Who was the Custodial Parent in 2021?
If you were the custodial parent in 2021, you don't need Form 8332. If the other parent was the custodial parent in 2021, they sign and give you Form 8332 to release their claim to you.
If this applies to you, you don't have to file Form 8332 with your tax return, just keep it as documentation.
