@MeMe25 I live in Florida but I think it’s ridiculous that they can take from the spouse and kids! I get the one who owes the support but don’t take our kids!
@GiseleD Dear I filed my taxes and havent received my return yet and I filed injured spouse. My stimulus was taken along with my husbands. So, what you are saying is to not file another form because one was already filed and the IRS should notice and give it back once my taxes are disbursed. Please elaborate on if we are wrong because people monies were obviously taken even though they filed the form and already received their taxes.
They received half of my taxes. I also received a letter with both of our names and one with just his for the 1200 stimulus amount. They both went to child support. I've been on hold for 30 minutes trying to contact the Office of the Attorney General. It seems to me, there is going to be a run around on this. I don't think they figured or considered those who filed injured spouse allocation .
You were able to get on the phone with someone? Please let me know what you’ve found out! I’ve reached out to my local news station and received no response back. I have no idea what to do! I need the $1200 that I’m entitled to. It’s not fair that the money due to help us during this difficult time has to go to a debt that isn’t my own after I have filed the appropriate paper work with my taxes as requested by the IRS.
@mmartinez4069 This is so ridiculous and nobody from turbo tax has any answers. But, can withdraw a payment for tax preparation fast. I need answers this is our tax preparer choice please help us
It took like 2-3 months to receive my refund when I filed jointly and filed the injured spouse.
@Drie I am not sure what to do either. I have been told two separate things. We won’t know what exactly to do until the irs updates and lets everyone know. I’m as lost as everyone else.
A petition would be a good way to approach this, I just wonder how long something like that would take. I need my $1200 now. This is so annoying! I said in another post that I’ve contacted my local news, but have Of course not received a response, although they have read my message through Facebook that I sent.
I spoke with the IRS this morning. The woman I talked to said I was the first to ask about this. So she left a message for her supervisor when she returns tommorrow. She advised me I should write to the department of treasury fiscal bureau where I received the letter from explaining I filed injured spouse with my taxes. Also I do believe attorney general would be a good contact. Could you tell me the number you are calling for the attorney general ?
No one ever answered. 😠 I wouldn't see a point in refiling a form since most of us already did. I just don't think they thought about it when sending out the stimulus relief. Let me know if anyone finds out anything . They have to respond if there is a lot of us out there unless they want to get that Child Support money.
I'm in Texas. It should be the number under the Office of Attorney General for the Child Support Unit in your town. (The middle of the page you received where they took your stimulus check)
Child support in America is a joke I have received child support and I have watch my late husband and current husband be completely f over by child support. We file all this stuff every year and they steal our money to gain money because they are getting interest holding our money. Do not make custodial parents prove income in Most place so they lie in court and tell Noncustodial parents to get a lawyer. Last time I check noncustodial parents have rights too and we pay taxes but child support does nothing to protect them
My now ex-husband's portion of the tax return always went to his first ex-wife, I filed Injured Spouse and received my portion. We filed our 2019 taxes in January, before our divorce, I filed the Injured Spouse as usual and I got my refund in February. Yesterday I got 2 letters from the IRS. One was to the ex, that said his stimulus check went to the back child support. The other letter stated that my stimulus check also went to the child support. I was able to finally get through to a person at the Michigan Child Support Unit. I was told they just got information from the IRS stating a new injured spouse form needs to be filed, even if one was filed with the taxes. Nowhere on the IRS site does it say if there are special instructions how file a duplicate form.
I called the local child support office in my town. Of course it was a voicemail and they are working limited hours, but on the TOP offset website, it says to contact the agency receiving the money. There isn't really a way (that I can find) to contact TOP. I filed my tax return back in Feb. with my Injured Spouse Form, and received my part of the refund (offset was sent to child support) back in March. In all of the research I've done, I have seen where it said that TOP may take weeks to get the stimulus money sent to the child support agency, so maybe they hold it until that point. It is very frustrating and upsetting that no one has an answer. At least if we knew it was coming, that would give me some piece of mind. I'm thankful for this group, so that I know I'm not the only one feeling this way.
