I bought a house in 2008 and I went through a divorce I guess she claimed it all when I was one that payed on house to. My tax refund was rejected and I have the form and divorce papers and need to get my refund not sure where to go from here.

If you qualified for the 2008 credit, it was treated as an interest-free loan. The IRS required those homebuyers to repay the credit over a 15-year period through an individual federal income tax increase. The credit did not have to be repaid by those who purchased homes in 2009 and 2010, with some exceptions.
if you didn't claim the credit in 2008 it's too late. if you took the credit in 2008 if the home was
transferred to a spouse (or ex-spouse as part of a divorce settlement), the spouse who received the home is
responsible for repaying the credit (regardless of whether he or she was the purchaser)
