I won a civil suit. I hired a surveyor to short plat my property to sell off a portion. The surveyor put the final boundary line in the wrong spot. It was far too close to my shop making it virtually unusable because the doors are now too close to the boundary line. I sued in the amount it would cost to rebuild a new shop to a new location further from the line. When he pays me the amount I was awarded, is this taxable income? Seems like it shouldn't be because the amount awarded was to fix the problem he caused. And if it is taxed, I wouldn't have enough money left to address the issue. Not to mention the $30k it cost me to litigate it.
