My x husband"s and our divorce was final in July of 2022. Can we still file together? Cause once crunching the numbers he will owe some what of $4500.

I just need to find the best filling option. I haven't worked in 4 years. I went back to work. But I'm a server so I have always owed taxes. Now I have kids I get the tax credit. But Filling separate puts him in a bind. Can we file together?

No.   If you were divorced before the end of 2022 you cannot file as married for 2022.  Your filing status is determined as of the end of the tax year.  If you are the custodial parent of the children then you can file as Head of Household.   Your spouse files as Single.

 

However, if you have a signed agreement 8332 -----   that allows you to file HOH, get earned income credit and the childcare credit, and would allow him to claim the children for the child tax credit.
