Assuming that you are a US citizen/resident alien  while your spouse is a non-resident alien --- is your spouse in the USA, Mexico, Canada or India? If the  spouse is here in the USA , what visa? If you are not a citizen, what visa, when did you enter the country? if you have children , what visa / status?
