Married filing separately health insurance?

My husband and I are filing separately. He did not have insurance, but I did. Do I have to claim that he didn't have insurance, or can I claim that my household was completely covered because he has already claimed he didn't have insurance and was fined.

My I enquire why you are filing MFS? I ask, because that is the most expensive way to go usually resulting in the highest tax liability for both. But yes, if you're MFS you must still indicate that he did not have insurance IF the program asks you. I can't see why it would ask you about your spouse's coverage though. But I'm no expert on the ACA laws either.

We're MFS because my student loan payments are income-based by my income only, not his.

Is this a case where you are behind on payments and any refund due is garnished? If so, there is a way to file MFJ and not have his income included/considered.

I would think not filing MFS. Would fully expect he will report that on his own return.
