I am married, but not stayed for a single day together in same state.

I live and work in a State Tax state and spouse lives and works in a state with no state payroll tax.

Spouse might not share their W2

can I change my tax filing from married and filing jointly to married single ?

will I be fined ( because payed less tax of joint filing ) ?

Am I responsible for any of her taxes if filing married filing single ?

Hello Anilveera,

Yes, you can file married filing separately.  If you have dependents you may also be able to file as Head of Household, if you and your spouse lived apart for the last six months of the year.

If you file Married Filing Separately you will only put your information (W-2's, etc.) on the return but you will need to enter your spouses name and SSN on the return.

Thanks

Lydia
