If you are married filing jointly how many kids are you able to claim?

My kids father is married they have 2 children together and one of her own before him which makes 3 kids in their home. If I'm correct one person can claim up to 3 kids. He want to claim 1 of our kids together. So what I'm asking is if they file together are they allowed to claim 4 kids?

If you are married filing jointly how many kids are you able to claim?

There is not a limit on the number of children that can be claimed as a dependent on a tax return, no matter what filing status is used, as long as the qualifications for claiming a dependent are met.  The same is true for most tax credits associated with dependents.

However, there is a limitation associated with the Earned Income Tax Credit (EITC).  There can be more than three children listed on the tax return as dependents, but the EITC is only calculated based on a maximum of three children.
